Booking Tickets

The Arena's ticketing services provider is Eventim UK Limited ("EVENTIM")

All tickets are subject to a booking fee and venue facility fee of 55p per ticket. Any shows going on sale after Wednesday 30 August 2017 a venue facility fee of £1.20 will be charged per ticket. The venue facility fee covers the increased property rates introduced by central government in 2017 and the extensive security measures added for public safety.

Manchester Arena Terms and Conditions of Entry

1. DEFINITIONS AND INTERPRETATION  

1.1 In these terms, the following definitions apply:

“Arena” means the Manchester Arena, Hunts Bank, Manchester, M3 1AR;

“Event” means any concert, music performance, play, sporting event, conference, exhibition or other performance taking place at the Arena;

“Organiser” means any person organising an Event in any part of the Arena;

“Person” includes individuals, unincorporated bodies, government entities, companies and corporations;

“SMG” “we” or “us” means any or all of the following companies: SMG (UK) Limited; SMG Europe Holdings Limited; SMG Theatres Limited; SMG Europe; SMG Europe Events Limited; SMG World Class Limited; and Park Arena Limited. It also includes, where appropriate, SMG’s agents, employees, and sub-contractors (including, without limitation, and where appropriate, Showsec International Limited or other security services contracted by SMG or the Organiser in connection with an Event);

“Terms” means these terms and conditions;

“Ticket” means a valid ticket, wristband or other approved admission document giving the bearer the right to enter certain parts of the Arena and/or attend an Event;

“Ticket Agent” means a Person approved by the Organiser and/or SMG to sell tickets for an Event.

 

2. APPLICATION OF THESE TERMS AND CONDITIONS

2.1 These terms and conditions govern your admission and conduct in the Arena. By entering, or attempting to enter, the Arena, you agree to be bound by these Terms.

2.2 These Terms supersede any previous issued terms and conditions.

2.3 Ticket Agents and/or Organisers may have additional terms and conditions which apply to an Event and to which you agree to be bound. In the event of any inconsistency between the Ticket Agent and/or Organiser’s terms and conditions, and these Terms, these Terms will take priority.

2.4 SMG reserves the right to amend these Terms from time to time at its sole discretion. You are responsible for ensuring you have read and understood any Terms in force at the time of entering or attempting to enter the Arena.

 

3. TICKETS

3.1 The Ticket Agent is Eventim UK Limited (its authorised subsidiaries and sub-contractors).

3.2 Tickets cannot be exchanged or refunded after purchase other than in accordance with these Terms and the Ticket Agent’s terms. Please check your tickets carefully as mistakes cannot always be rectified.

3.3 If we, or an Organiser, have reasonable grounds to believe that a Ticket has been re-sold or transferred for profit or commercial gain by any Person other than the Ticket Agent, SMG or the Organiser has the right to refuse to admit the Ticket holder to the Arena or to eject the Ticket holder from the Arena without a refund.

3.4 You must keep your Ticket with you at all times at an Event. Your ticket may be invalidated if any part of it is removed, defaced or altered. Lost or stolen Tickets will not be replaced.

3.5 When purchasing Tickets you may be restricted to a maximum number per person; per credit/ debit card; and/or per household. SMG and the Ticket Agent reserve the right to cancel any Tickets purchased in excess of this maximum number or otherwise in breach of these Terms without prior notice or refund.

3.6 Tickets may not be used in connection with advertising, promotions, competitions, or sweepstakes unless prior written consent is obtained from SMG and the Organiser. Nothing in this clause shall entitle any person to use, display, alter, copy or otherwise deal in any manner whatsoever with SMG’s or the Organiser’s intellectual property rights.

 

4. ENTRY TO THE ARENA AND EVENTS

4.1 SMG reserves the right, at its absolute discretion, to refuse admission to any person and/or to eject any person from the Arena if it considers that person’s behaviour or conduct is causing, or is likely to cause (without limitation), damage; injury; nuisance; or distress to others: without a refund.

4.2 You must produce a valid Ticket to gain entry to the Arena and upon request for inspection. Failure to produce your Ticket on request may result in you being ejected from the Arena without a refund.

4.3 In order to ensure the Arena is a safe environment, we may search you, your clothing, bags or other items at any time at our sole discretion. Refusal or failure to co-operate in any search may result in you being refused entry or being ejected from the Arena without refund.

4.4 We reserve the right to prohibit certain items within the Arena from time to time. Prohibited items include (without limitation):

a) Food and beverage or containers for storing food or beverage;
b) Professional cameras, recording equipment and computer tablets;
c) Any items which are or may be illegal including, without limitation, weapons, fireworks, ammunition, drugs and other controlled substances;
d) Whistles, drums and other instruments;
e) Large umbrellas or other items which, in our opinion, may cause danger or disruption at an Event;
f) Items which a performing artist, their management or Organiser requests that we prohibit; and
g) Any other items which we believe may cause danger or disruption at an Event (regardless of whether or not they are illegal or carried for a specific purpose).

4.5 All prohibited items must be disposed of or surrendered before, or upon, entry to the Arena. Failure to surrender any prohibited items may result in you being refused entry or being ejected from the Arena without refund

4.6 It is your responsibility to keep your personal possessions safe at all times whilst at the Arena. Neither SMG nor the Organiser shall be liable for the loss, damage or theft of any items.

4.7 With the exception of guide or assistance dogs, no animals are permitted in the Arena. Customers wishing to attend an Event with a guide or assistance dog are requested to contact the Arena in advance of the Event for assistance.

 

5. EVENTS AND OUR POLICIES

5.1 The Arena operates a strict no smoking policy. It is illegal to smoke anywhere at the Arena and anyone caught smoking will be ejected from the Arena without refund.
Use of E-cigarettes is not permitted in the Arena.

5.2 All attendees at the Arena consent to being filmed or recorded (images and sound) by or on behalf of us, the Organiser or another authorised third party, and consent to their images (or likenesses) being used in any film, recording, photograph or other footage (“Recording”) of the Event. All rights in the Recording shall be owned by the Organiser, authorised third party or us absolutely. You agree that any Recording may be used by us, the Organiser or authorised third party in any media and for any purpose throughout the world, including, without limitation, for promotional materials and activities, merchandise, DVD’s or other commercial activities. No payment or compensation for use of your image or likeness shall be payable to you.

5.3 By attending the Arena you consent to being filmed or recorded by the police or other security staff for the purpose of safety and monitoring at the Arena.

5.4 The use of any cameras, video or sound recording equipment or devices in the Arena without our prior written consent is strictly prohibited. Any recordings made in breach of this clause may be seized or destroyed by us without any compensation or payment to you.

5.5 The performance start times and/or estimated duration advertised on tickets, promotional literature, websites and/or social media are approximate and subject to change. It is your responsibility to ensure you arrive at the Arena in sufficient time prior to the start of an Event. Failure to arrive on time may result in admission being delayed or refused, without refund.
Every effort is made to admit latecomers in a suitable break at the Event, however, admission cannot be guaranteed in those circumstances, and is at the discretion of SMG and the Organiser.

5.6 There is no re-admission once you have left the Arena except with the consent of SMG at its absolute discretion. This does not include leaving the seating or performance areas to use the Arena WC’s or other facilities, or to purchase food and beverages or merchandise at the Arena.

5.7 If your ticket specifies a seat number, it will only entitle you to a seat of a value corresponding to that stated on your Ticket. We reserve the right to provide an alternative seat to the one specified on your Ticket if it is not possible or desirable (due to operational or other reasons, and at our sole discretion) to allow you to occupy the seat specified on your Ticket.
In the case of a designated seat Ticket, you are permitted to stand or dance within the designated seat space. However, please be respectful and mindful of other members of the audience.

5.8 Please note that other members of audience may stand or dance in front of you and restrict your view. No refunds will be offered in the event your view is restricted in those circumstances.

5.9 Please be aware that strobe, laser, flashing or other lighting effects may be used during an Event.

5.10 Please be aware that prolonged exposure to loud noise may cause damage to your hearing. We strongly advise that children attending Events wear suitable hearing protection. Ear protectors are normally available for purchase at the Merchandise stand (subject to availability), together with disposable ear plugs free of charge (subject to availability) from Customer Services. It is your responsibility to determine the most appropriate hearing protection for you and any children who are attending an Event with you.

5.11 Events may be age restricted. Notwithstanding any age restrictions, it is the responsibility of the accompanying adult to determine the suitability of the Event for any children attending. No refunds will be offered in circumstances where the accompanying adult decides, following the purchase of a Ticket, that the Event will not be suitable for any children for whom Tickets were purchased. Furthermore, no refunds will be offered in circumstances where the content of the Event, or the behaviour of other customers, causes offence to children or the accompanying adult.

 

6. FOOD AND BEVERAGE

6.1 A variety of food and beverages are available at the Arena. Only food and beverage purchased at the Arena may be consumed on the premises.

6.2 When purchasing alcohol, you may be asked for proof of age. We support the “Challenge 21” scheme.

6.3 We reserve the right to refuse to serve you alcohol if we consider that you are intoxicated or likely to become intoxicated if we serve you.

 

7. OFFICIAL MERCHANDISE

7.1 Customers should be aware that official merchandise is only usually available for sale within the Arena.

7.2 Customers are prohibited from selling or offering for sale, any items within the Arena. This prohibition includes, without limitation, merchandise, tickets, food or beverages, cigarettes, e-cigarettes or any other prohibited items

7.3 Customers are prohibited from displaying, promoting, or distributing, any advertising or promotional materials or messages, or any other materials containing religious, political or other messages liable to cause offence.

 

8. CANCELLATION OR POSTPONEMENT OF EVENT

8.1 The Organiser may make changes to the Event. Provided that the change is not material (for example it is a change to the performance time or supporting act), no refunds of tickets will be available.

8.2 SMG and the Organiser reserve the right to alter or vary the scheduled or advertised Event in the event of an unforeseen circumstance or the occurrence of any event or circumstance beyond its control (a “Force Majeure Event”). SMG shall not be liable for any damages, loss or disappointment arising from any alterations or changes made.

8.3 If the Event is cancelled, postponed or materially altered, you may be entitled to a refund of your Ticket from the ticket agent you purchased the Tickets from. Please see the ticket agent’s terms and conditions for more information. Any booking, service or administration fees charged by SMG are non-refundable. No refunds will be processed by SMG directly.

8.4 If an Event is postponed and re-scheduled, your original Ticket will entitle you to attend the postponed and re-scheduled Event. It is your responsibility to check the date and time of any postponed or re-scheduled Event.

 

9. HOSPITALITY – PREMIER LOUNGE, THE VIEW, and PLUS 1

9.1 The terms and conditions set out above and below apply to entry to The View, Premier Lounge and Plus1 (“the Hospitality Venues”). In addition, the following specific terms and conditions apply to all admissions to the Hospitality Venues.

9.2 To gain entry to a Hospitality Venue you must have a valid membership or hospitality contract or be the guest of a person or organisation with a valid membership or hospitality contract, or be invited by SMG.

9.3 To gain entry to the Hospitality Venues you must be 18 years or over, unless otherwise specified by SMG. You may be required to provide evidence of your identity and age: either a photo ID driving licence or Passport is acceptable.

9.4 Capacity at the Hospitality Venues is limited. Please ensure you attend early to avoid disappointment.

 

10. LIMIT OF LIABILITY

10.1 If you suffer loss and damage as a direct result of our negligence, our liability to you will be limited to an amount equal to the face value of the Ticket purchased by you for the Event. Under no circumstances will our liability extend to costs or losses incurred in connection with the Event, (including cancellation, postponement or rescheduling of an Event); travel, accommodation or hospitality arrangements; loss of enjoyment or disappointment.

10.2 SMG shall have no liability to you in the event the above loss or damage is caused by a “Force Majeure Event”, i.e an event beyond SMG or the Organiser’s control including (without limitation) any act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, flood, explosion, extreme weather conditions, medical emergency, theft of essential equipment, strike, lock out, malicious damage, or acts or regulations of national governments.

10.3 Nothing in these Terms excludes, or purports to exclude, our liability for death or personal injury caused by our negligence, nor from any other form of liability which cannot be excluded or limited in law.

 

11. GENERAL

11.1 If any part of these Terms are found by a Court, tribunal or other administrative body of competent jurisdiction to be unenforceable or invalid for any reason, that provision is to be severed from the Terms and the remaining provisions of the Terms will otherwise remain in full force.

11.2 No act, delay or omission by SMG in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

11.3 SMG shall be entitled to assign any of its rights or obligations under these Terms.

11.4 These Terms will be governed by the law of England and Wales. Disputes will be submitted to the exclusive jurisdiction of the Courts of England and Wales.

15. Liability for our mistakes
WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL LOSS, DAMAGE OR EXPENSES (INCLUDING WITHOUT LIMITATION ANY LOSS OF MATERIALS, INTERRUPTION OF SERVICE OR WASTED EXPENDITURE) HOWSOEVER ARISING OUT OF YOUR USE OF THIS WEBSITE, WHERE:
(A) THERE IS NO BREACH OF A LEGAL DUTY OF CARE OWED TO YOU BY US;
(B) THE LOSS OR DAMAGE IS NOT A REASONABLY FORESEEABLE RESULT OF ANY SUCH BREACH; OR
(C) ANY LOSS OR DAMAGE OR INCREASE IN LOSS OR DAMAGE RESULTS FROM A BREACH BY YOU OF THESE TERMS AND CONDITIONS.
THE FOREGOING LIMITATIONS SHALL APPLY REGARDLESS OF THEORY UNDER WHICH SUCH CAUSE OF ACTION IS BROUGHT, WHETHER IN CONTRACT, TORT, WARRANTY OR OTHERWISE.
NOTHING IN THESE TERMS AND CONDITIONS EXCLUDES OR LIMITS OUR LIABILITY FOR FRAUDULENT MISREPRESENTATION OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.

16. Indemnity
You agree to indemnify and hold SMG, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Website and/or breach of any of our terms and conditions including these Terms.

17. Third party rights
Nothing in these Terms and Conditions is intended to nor shall it confer a benefit on any third party under the Contracts (Rights of Third Parties) Act 1999 and a person who is not a party to these Terms and Conditions has no rights to enforce them.

18. Waiver
No delay or decision not to enforce rights under these terms and conditions will constitute a waiver of the right to do so and will not affect rights in relation to any subsequent breach.

19. Invalidity
If any of these Terms are found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other conditions which shall remain in full force and effect.
If any of these Terms are found to be invalid or unenforceable but would cease to be invalid or unenforceable if some part of the provision were deleted, the provision in question shall apply with such modification as may be necessary to make valid and enforceable. 

20. Governing law
These Terms and Conditions are subject to the laws of England and Wales and each of us hereby submits to the exclusive jurisdiction of the English and Welsh courts.

WE RESERVE THE RIGHT TO CHANGE THESE TERMS AND CONDITIONS AT ANY TIME. THE NEW VERSION WILL BE POSTED ON THIS WEBSITE AND WILL TAKE EFFECT IMMEDIATELY UPON POSTING.

IF YOU USE THE WEBSITE AFTER THE NEW TERMS AND CONDITION HAVE COME INTO EFFECT, YOU WILL BE INDICATING YOUR AGREEMEN TO BE BOUND BY THESE NEW TERMS AND CONDITIONS.

 

Competition Rules

Please take a few moments to read through these Competition Rules ("Rules").

1. By entering and participating in any contest or competition ("Competition") all entrants to are bound by and agree to participate in the Competition in accordance with these Rules. All entry instructions form part of these Rules. If you do not agree to these Rules, please do not enter the Competition.

2. We reserve the right to cancel or modify any Competition or these Rules at any time without prior notice. Any changes will be effective once posted on this site. A copy of the Rules may also be obtained by sending a stamped self-addressed envelope addressed to: Competition Rules, SMG Europe Head Office, Victoria Station, Manchester M3 1AR.

3. Our decisions on all matters relating to any Competition including disputes and results will be final and no correspondence or discussion shall be entered into.

4. Competitions may be organised and operated by SMG (UK) Ltd and/or any of its sponsor(s).

Entry to Competitions
5. All entrants to any Competition must be resident in the U.K. Multiple entries to a Competition are allowed. No purchase is necessary to enter a Competition. We may disqualify any entrant if we have reasonable grounds to believe the entrant has breached any of these Rules.
6. No employees (including family members) of SMG (UK) Ltd, any connected or group company or any company involved in the Competition, are eligible to enter the Competition. We reserve the right to verify the eligibility of all entrants.
7. Competitions may have their own requirements as to eligibility. Age restrictions may apply to Competitions. You may be asked to provide written proof of age.
8. By entering any Competition, you represent and warrant to us that information submitted by you is truthful and accurate.
9. By entering any Competition you represent and warrant to us that you have legal capacity to enter the Competition or that you have parental consent to your entry of the Competition.
10. Competition entries are free unless otherwise specified. 
11. Where entry to a Competition involves using a premium rate text number, calls will normally cost a premium charge as specified plus the standard rate for you mobile network provider. You should check with your service provider for details. Cost of calls from different mobile phone service providers may vary.
12. We can accept no responsibility for, and reserve the right to refuse, entries which are corrupt, incomplete, lost or damaged or fail to arrive by the closing date.

Prizes

13. Winners will be contacted by e-mail or via social media within 24 hours. Only one prize per entrant will be awarded. 
14. Please note, the closing date for the JD Sports win-a-pair-of-trainers competition is at the end of each calendar month. Winners will be contacted by e-mail within 24 hours. Only one prize per entrant will be awarded. Claims for prizes must be made by e-mail to event.marketing@smg-europe.com within 24 hours of receiving notification.
15. Closing dates and draw dates for Competitions shall be as specified. Prizes are allocated randomly from correct entries received unless stated otherwise for the particular Competition. Prizes are as specified on the Competition pages or social media posts on Facebook or Twitter.
Winners of Competitions will be notified by e-mail, text, or via social media (Facebook or Twitter). If we are unable to contact you we may select an alternate winner.
16. Failure to claim a prize within 7 days (or as specified) of notification may result in disqualification.
17. Prizes are not transferable and there is no cash alternative. We may exchange any prize for one of the same or greater value.
18. Prizes will be delivered to winners via the postal service or may be collected from box office. We do not accept any liability for prizes which are lost, delayed or damaged in the post or otherwise not received.
19. Prizes may be for events and we will not replace a prize if the event has been is cancelled or postponed.
20. You may not commit SMG (UK) Limited to any expense or other obligation unless approved by us in writing.
21. In the event of disqualification of a winner for any reason, we may decide in our sole discretion to select another winner. In this event, a further entrant will be selected on the same criteria and subject to these Rules. A list of winners for a Competition can be obtained by writing to us at SMG Europe Head Office, Victoria Station, Manchester M3 1AR, naming the competition and including a self-addressed stamped envelope.

Intellectual Property Rights and Data Protection
22. All rights of whatever nature in any Competition and Competition entries vest exclusively in SMG (UK) Ltd and/or its sponsor(s).  
23. Any and all information that you submit must not infringe the intellectual property rights or any rights to privacy or other rights of any third party. Entries must not contain anything, which is libellous, defamatory, obscene, indecent, harassing or threatening.
24. You may be requested to take part in promotional activity and we reserve the right to use the names of winners, including their images, photographs and other media recordings in publicity materials in any media (including on our websites and those of any competition partners) anywhere in the world.
25. Any personal data relating to entrants will be used solely in accordance with our Privacy Policy.

Liability
26. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials relating to the Competition.
27.  SMG (UK) Ltd shall have no liability whatsoever in respect to competitions operated on behalf of third parties, e.g. any of our sponsors.

General
These Rules, any materials relating to any specific Competition, our General Terms of Use and Privacy Policy contain all the terms applicable to the Competition.
29. The Competition and these Rules will be governed by English law and the parties irrevocably submit to the exclusive jurisdiction of the English courts.

Priority Pass Membership Terms & Conditions

If you do not agree with any part of these terms and conditions ("Terms") do not place an order. If you have any questions please contact event marketing at email: event.marketing@smg-europe.com

You must be at least 18 years of age to subscribe and become a member of the Priority Pass scheme. By completing and submitting the registration form and by agreeing to these Terms you warrant and represent that you are at least 18 years of age.

You should print a copy of these Terms for future reference. We will not file a copy specifically in relation to you, and they may not be accessible on our website in future.

1. Membership Contract

1.1. Your membership contract will be with SMG (UK) Limited ("we/us/our"), a company registered in England and Wales under registered number 821116 whose registered office is at SMG Europe Head Office, Victoria Station, Hunts Bank, Manchester M3 1AR. Our VAT number is 844280722.

1.2. In order to apply to become a member, please complete and submit the registration form.

1.3. If you make any input errors during the registration process, these may be identified and corrected by you before the registration form is submitted or by logging on to My EVENTIM at http://www.eventim.co.uk/myeventim .

1.4. When placing your membership application on-line your credit/debit card will be debited when you click "Submit Order". Although you will either see a page or receive an email acknowledging that your application has been received successfully and is being processed, the contract between us is not formed at this point.

1.5. Once payment has been received by us we will confirm that your application has been accepted by sending an email to you at the email address you provide in the registration form. Our acceptance of your application brings into existence a legally binding contract between us.

1.6. If you complete the registration form, we via EVENTIM will provide you with or you will be asked to choose a user ID and password. You must ensure that your user ID and password are kept confidential.

1.7. You are obliged to provide correct contact and credit/debit card details when you apply for membership and failure to do so may invalidate your membership. Responsibility to provide accurate information is continuous throughout your membership and you must notify us if any information provided to us changes.

2. Right to Refuse Applications

We reserve the right not to accept or process your membership application for any reason. All applications are subject to validation checks and authorisation by your payment card issuer. If we do not accept your membership application and your credit/debit card has already been debited, we will notify you and refund your card in full immediately.

3. Cancellations and Refunds

3.1. You may cancel your membership contract with us at any time up to the end of the seventh working day from the date you placed your application. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

3.2. To cancel your contract you must notify us in writing by email to priority.pass@smg-europe.com

3.3. Once you have notified us that you are cancelling your contract in accordance with clause 3.1 and 3.2, any sum debited to us from your credit or debit card will be re-credited to your account as soon as possible and in any event within 30 days from the date of your cancellation email.

3.4. After 7 days following your application, membership fees cannot be refunded or exchanged and memberships are non-transferrable. The Manchester Arena Priority Pass is for the registered member's personal use only.

3.5. Membership of the Priority Pass scheme is for a term of 12 months.

4. Fees Information

4.1. The membership fees ("Fees") are as set out on our website, click here for more details. All Fees stated on our website are stated inclusive of VAT.

4.2. You must pay to us the Fees in respect of your membership of Priority Pass scheme, in cleared funds, in one payment in advance on submission by you to us of the registration form.

4.3. We may vary the Fees from time to time by posting new fees on our website. Such variations will not affect memberships that have already been paid for.

4.4. Payments of all of the Fees must be paid in UK Pounds Sterling by credit or debit card only.

5. Membership Benefits

5.1. Membership will entitle you to a variety of benefits, details of which can be found here. Please note that these benefits are subject to change from time to time at our discretion.

5.2. Membership does not guarantee that you will be able to purchase tickets to a particular event, nor does it guarantee that you will be able to purchase a certain type of ticket or quantity of tickets.

5.3. By completing and submitting the registration form you are consenting to the collection, use and transfer of your personal data and information to enable us to fulfil our contract in accordance with these Terms and our Privacy Policy and to receive regular membership emails from us.

6. Termination

6.1. You may cancel your membership and may terminate your contract with us at any time by sending us written notice by email to priority.pass@smg-europe.com please note in the event that you terminate your contract with us (other than in accordance with clause 3.1), membership Fees cannot be refunded.

6.2. We may terminate our contract immediately (with or without giving written notice to you) if you commit any breach of any term of the Terms.

6.3. In the event you terminate your contract and your membership in accordance with clause 6.1 above, the termination shall take effect at the end of the relevant pre-paid year. In the event that you do not wish to continue to receive the membership benefits (including email updates) up until the end of the pre-paid year, please notify us in writing by sending an email to priority.pass@smg-europe.com

6.4. In the event we terminate your contract with us in accordance with clause

6.2, termination shall take effect immediately, you will not be entitled to any refund of any membership Fees in any way.

7. Limitations and Exclusions of Liability

7.1. Nothing in these Terms will: (a) limit or exclude our or your liability for death or personal injury resulting from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that may not be excluded under applicable law.

7.2. The limitations and exclusions of liability set out in this clause and elsewhere in these Terms: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the Terms or in relation to the subject matter of the Terms, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

7.3. We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

7.4. We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

7.5. We will not be liable to you in respect of any loss or corruption of any data, database or software.

7.6. We assume no liability or responsibility for your failure to receive email notifications if such failure results from an inaccurate or out-of-date email address or for any email notifications which are corrupt, lost, delayed, blocked or fail to be delivered for any other reason outside of our reasonable control, for example, if our emails are blocked by your or your ISPs spam filter. You should ensure that your email address can receive emails from our domain.

7.7. We will not be liable to you in respect of any special, indirect or consequential loss or damage.

7.8. Our aggregate liability to you under these Terms will not exceed the total amount paid by you to us under these Terms.

8. General

8.1. Please see the our Website User Terms and Conditions and Privacy Policy which must be accepted prior to submitting your registration form.

8.2. The purchase of tickets shall be subject to our Booking Terms and/or any terms and conditions of our sub-contractors or authorised agents.

8.3. In the event of a conflict between the Website User Terms and Conditions, Privacy Policy and Booking Terms and these Terms, these Terms shall prevail.

8.4. Where a Force Majeure event gives rise to a failure or delay in either party performing its obligations under these Terms, those obligations will be suspended for the duration of the Force Majeure event. A party who becomes aware of a Force Majeure event which gives rise to, or which is likely to give rise to, any failure or delay in performing its obligations under these Terms, will promptly notify the other. The affected party will take reasonable steps to mitigate the effects of the Force Majeure event. A Force Majeure event shall mean an act, event, omission beyond the reasonable control of a party including riots, war, acts of terrorism, industrial dispute, fire, flood, storm, earthquake or other disaster.

8.5. We may revise these Terms from time-to-time. Revised terms and conditions will apply from the date of the publication of the revised terms and conditions. Please check this page regularly to ensure you are familiar with the current version.

8.6. We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these Terms without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these Terms.

8.7. If a provision of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

8.8. These Terms are for the benefit of you and us, and are not intended to benefit any third party or be enforceable by any third party. The exercises of our and your rights in relation to these Terms are not subject to the consent of any third party.

8.9. The Terms, together with our Website User Terms and Conditions, Privacy Policy and Booking Terms, constitute the entire agreement between you and us in relation to your membership, and supersede all previous agreements.

8.10. These Terms will be governed by and construed in accordance with English law, and any disputes relating to these Terms will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

1.2.       In order to apply to become a member, please send a SMS text message on your UK mobile phone to the specified text code.
1.3.       When placing your Priority Pass SMS membership application by sending an SMS text message to the specified short code, the order is not completed when you send. Your mobile operator will receive this purchase request and will verify that you have enabled premium SMS purchase and that you have enough credit on your phone.  The mobile operator will then pass the purchase request to us. If you do not have sufficient credit or if you have you phone is not enabled for premium services you will not be charged. Call your mobile service provider if you wish to enable premium services.
1.4.       Once the SMS has been received by us, we will check whether you already have an active membership and if so, we will not collect payment from you and will instead advise you with a text message.  Once we accept your purchase request we will send you a receipt via SMS text. When your mobile phone receives this text receipt a legally binding contract between us is brought into existence.
1.5.       Once you have received your text receipt on your phone, your mobile operator will charge your bill with the annual membership fee.
1.6.       You should now go to the website http://www.telecoms-live.net/ to complete the registration form to provide your details including name, email address and a password.  You must ensure that your password is kept confidential. 
1.7.       You are obliged to provide correct contact details when you apply for membership and failure to do so may invalidate your membership. Responsibility to provide accurate information is continuous throughout your membership and you must notify us if any information provided to us changes.
1.8.       If you make any input errors during the registration process, these may be identified and corrected by you before the registration form is submitted or by logging on to Priority Pass at http://www.telecoms-live.net/
